SMS Texting Terms and Conditions

  1. Policy: Buckles & Buckles PLC is a law firm which engages in the collection of consumer debt on behalf of our creditor clients. Our goal is to communicate with consumers and their attorneys to resolve account issues in a polite and professional manner.  We offer SMS texting service to facilitate communication pursuant to these terms and conditions. Consent to the SMS Terms and Conditions is never a condition of settlement, payment plan or resolution. Additionally, all text messages are secured and encrypted.
  2. How to START texting Buckles & Buckles PLC:
    • First you must expressly provide consent to Buckles & Buckles PLC to text you at the number you provide to the firm.
    • You may text us at 248-647-5050 and type START.
    • If you write us, or call us toll free at 866 729 6411 or email us at staff@bucklesandbucklesplc.com, we will ask you to text us at 248-647-5050 and type START on your wireless device.
    • We will respond to your START request by sending you a text to verify your identity so we can insure your privacy and the security of your account information.
    • Once you provide this verification information, and we confirm you are the owner of the account(s) upon which we are collecting, we will send you a text asking you to AGREE to these terms and conditions.
    • Upon receipt of your text agreeing to these terms and conditions, you will receive a text advising you are now enrolled in our texting service and asking “How can we help you?”.
  3. Consent to Text/Opt In: You consent to be contacted via text by Buckles & Buckles PLC, including our attorneys, collection manager, legal assistant collectors, and our paralegals at the cellular phone number you have provided in conjunction with your account. You agree Buckles & Buckles PLC may text you using an automatic dialer.
    • Consumers responding with “AGREE” (as indicated above) to the text in which they receive these terms and conditions, acknowledge his/her agreement to these terms and conditions.
    • Consent to our texting SMS texting service is specific only to Buckles & Buckles PLC, and is in no way transferable to our client/s. If you wish to enroll in a texting service with any of our clients, you must consent to their program directly to start text messages from them.
  4. How to opt out:  If you wish to stop receiving text messages from Buckles & Buckles PLC, reply to any text message we have sent you and simply type STOP.
    • Your STOP request will become effective immediately.
    • After you text us STOP to opt out of the Buckles and Buckles PLCtexting service, you will receive a text from your wireless carrier that you have opted out of our texting service.
      • Or, if you simply text us and request us to discontinue texting you, we will endeavor to promptly remove your number from our texting service.
    • You may also opt out by calling us or sending us a letter or e mail. (See contact information above.) Upon receipt, we will promptly remove your number from our texting service.  See contact information in section 2 above.
    • An Opt Out of the Buckles & Buckles SMS texting service is specific only to Buckles & Buckles PLC, and does not affect any consent you previously provided to our client/s and is in no way transferable to our client/s. If you are specifically enrolled in a texting service with any of our clients, you must opt out of their program directly to stop text messages from them.
  5. Opt Out or HELP: You may Opt Out (see above) or ask for HELP via text, our website https://www.bucklesandbucklesplc.com/ or you may call, email, or write us a letter with any questions or concerns. Our contact information is below in section 8.
    • An Opt Out of the Buckles & Buckles SMS texting service is specific only to Buckles & Buckles PLC, and does not affect any consent you previously provided to our client/s and is in no way transferable to our client/s. If you are specifically enrolled in a texting service with any of our clients, you must opt out of their program directly to stop text messages from them.
  6. Can I opt back in?
    • To opt back into our texting service after you have opted out, text us UNSTOP and the consent process will begin again to verify your identity and to consent to these terms and conditions.
  7. Help or Support
    • If at any time you need our contact information or information on how to stop text messages, reply to any text message we have sent you and in the reply text simply type HELP.
    • Upon receiving your text message, we will send you a text message with this information.

  9. Wireless carriers: We have confirmed we are able to deliver text messages to the following wireless carriers: Sprint, T-Mobile, AT&T and Verizon.  If you have any questions about the applicability of your specific text plan or data plan, it is best to contact your wireless provider.
  10. What does it mean to be “enrolled” in the Buckles & Buckles texting service?​
    By enrolling in the Buckles & Buckles PLC texting service: 

    • OWNERSHIP: You represent that you are the owner and authorized user of the wireless device you use to receive and send text messages from Buckles & Buckles PLC.
    • IF YOU CHANGE YOUR NUMBER: You agree to immediately notify Buckles & Buckles PLC if you change your number or plan to provide your phone number to another person. It is the Buckles & Buckles PLC policy to avoid sending any texts to reassigned numbers.
      •  You agree to indemnify Buckles & Buckles PLC in full for all claims, expenses, and damages related to or caused in whole or in part by your failure to notify us if you change your telephone number, including, but not limited to, all claims, expenses, and damages related to or arising under the Telephone Consumer Protection Act.
    • CHARGES: You understand and agree that your mobile device carrier’s standard message data rates may apply to texts you or we send.
      • Buckles and Buckles PLC does not charge for any content; however, downloadable content may incur additional charges from your wireless carrier. You are solely responsible for any fees, including web access and/or data or text message charges that may be billed by your wireless carrier based on your individual plan. Please contact your wireless carrier for information about your messaging plan.
      • Your carrier may impose message or charge limitations on your account that are outside of our control. All charges are billed by and payable to your Wireless Carrier.
    • WARNING: You understand the text messages Buckles & Buckles PLC send may be seen by anyone with access to your mobile device. The text messages may include personal information about our collection of your account.  Accordingly, you agree to take steps to safeguard your phone and your text messages if you want them to remain private.
    • TEXTING TIMES:  You agree to notify us if you do not want messages sent at an inconvenient time.
      • Normally Buckles & Buckles PLC will send you text messages only between 9 a.m. and 5:00 p.m. business days, Monday – Friday, Eastern Time Zone.
      • If you want text messages sent at a different time of day, you agree to notify us of the time (including time zone) you want to receive texts.
      • You agree that if you travel to a different time zone and do not notify us, you may receive messages from our firm that are outside the 9 a.m. – 5 p.m. hours in the time zone in which you travel.
      • DO NOT TEXT AND DRIVE.  You agree that we are not liable for any damages, loss or injury incurred by you while texting and driving.
    • RESPONSE TIME: You understand that if you text us at a time other than between Monday – Friday 9 a.m. – 5 p.m., we will respond to you the next business day. We will endeavor to respond to you promptly.
    • DELAYS: You agree and understand that Buckles & Buckles PLC is not liable for any delays or failure of any SMS messages we send to you or you send to us, since delivery is subject to effective transmission from the network operator and processing by your wireless device.  Likewise, delays may occur if you turn off your mobile device or apply a setting that prevents/limits full application of your wireless service (e.g. airplane mode, do not disturb, etc.).
  11. What types of texts will you receive FROM Buckles & Buckles PLC?
    • In general, the texts Buckles & Buckles PLC send will provide you with information about your account.
    • Examples include, but are not limited to, balance notification, payment reminders, payment receipt if requested, overdue or non-payment notices, reminders regarding upcoming court hearings, reminders to sign and return important documents.
    • Some of the text messages we send may include links to websites. To access these websites, you will need a web browser and Internet access.
    • The number of text messages that you receive from us will vary.  We will endeavor to send you no more than three texts a week per account, unless we are engaging in an ongoing conversation with you regarding your account(s.)
  12. What may you text To Buckles & Buckles PLC?
    • You may ask Buckles & Buckles PLC questions regarding your account balance, payments, settlements, court hearings (if suit has been filed.)
    • Due to character limits on texting, Buckles & Buckles PLC may ask you to contact us via phone to better explain our answers to complicated questions.
    • You may register disputes, complaints or concerns about your account.  However, these may require a verbal discussion to resolve since texting only allows limited characters.
    • All texts to Buckles & Buckles PLC must be business appropriate and professional.  You agree not to use our texting service for solicitation, marketing material, harassment or inappropriate content.
  13. Urgent Matters: If you have an urgent and important matter regarding our collection of your account(s), we suggest you call Buckles & Buckles PLC directly to ensure prompt response and resolution. You may reach us at 248-647-5050 or toll free at 866-729-6411.
  14. Privacy Policy 
    • Data obtained from you in connection with this SMS service may include your mobile phone number, your carrier’s name, and the date, time, and content of your messages and other information that you may provide. We may use this information to contact you and to provide the services you request from us, and to otherwise operate, develop, and improve the service.
    • Your wireless carrier and other service providers may also collect data from your SMS usage, and their practices are governed by their own policies.
    • We will only use the information you provide to the service to transmit your text message or as otherwise described in this document. Nonetheless, we reserve the right at all times to disclose any information as necessary to satisfy any law, regulation, or governmental request, to avoid liability, or to protect our rights or property.
    • When you complete forms online or otherwise provide us information in connection with the service, you agree to provide accurate, complete, and true information.

  15. Dispute Resolution regarding Buckles & Buckles texting service for consumers:
    • It is our goal to communicate with consumers and resolve debt collection issues in a polite and professional manner. But if the issue to be resolved regards our texting service, this section outlines what is expected of both of us.
    • Most consumer concerns can be resolved quickly and to your satisfaction by contacting our Legal Compliance Manager, Jason Sims at 248-593-7122.
    • In the unlikely event that we are unable to resolve your concern or complaint that you may have about our texting service, we each agree to resolve any and all disputes regarding your or our use of the texting service through binding arbitration as set forth below.
  16. Mandatory, Bilateral Arbitration. Please read this carefully. It affects your rights. YOU AND BUCKLES & BUCKLES PLC AGREE THAT ANY DISPUTE, CONTROVERSY OR CLAIM ARISING OUT OF, OR RELATING TO, THE SMS TEXTING TERMS AND CONDITIONS OR OUR TEXTING SERVICE SHALL BE RESOLVED ONLY BY FINAL AND BINDING, BILATERAL ARBITRATION.
    • This agreement to arbitrate is intended to be broadly interpreted, and expressly includes claims brought under the Telephone Consumer Protection Act, 47 U.S.C. § 227 et seq., or any other statute, regulation, or legal or equitable theory arising out of, or relating to, these SMS Texting Terms and Conditions or our Texting Service.
    • You and Buckles & Buckles PLC hereby agree that the Federal Arbitration Act, 9 U.S.C. 1, et seq. (“FAA”) applies to this agreement to arbitrate, and governs all questions of whether a dispute is subject to arbitration.
    • Unless you and we agree otherwise in writing, arbitration shall be administered by the American Arbitration Association’s Consumer Arbitration Rules in effect at the time of filing of the arbitration (the “AAA’s Rules”).
    • However, just as a court would, the arbitrator or arbitrators must honor the terms and limitations in these terms and conditions, and can award damages and relief (including any attorneys’ fees) authorized by law and/or the AAA’s Rules.
    • The arbitration decision and award is final and binding, with some exceptions under the FAA, and judgment on the award may be entered in any court of competent jurisdiction.
    • YOU AGREE THAT, BY AGREEING TO THESE TERMS AND CONDITIONS, YOU AND BUCKLES & BUCKLES PLC ARE EACH WAIVING THE RIGHT TO A TRIAL BY JURY AND THE RIGHT TO PARTICIPATE IN ANY CLASS, REPRESENTATIVE, OR COLLECTIVE PROCEEDING AS IT RELATES TO OR ARISES OUT OF, THESE SMS TEXTING TERMS AND CONDITIONS OR OUR TEXTING SERVICE.
    • THIS AGREEMENT DOES NOT ALLOW FOR CLASS ARBITRATIONS EVEN IF THE PROCEDURES OR RULES OF THE AAA WOULD. RATHER, YOU AND WE ARE ONLY ENTITLED TO PURSUE ARBITRATION ON AN INDIVIDUAL, BILATERAL BASIS. FURTHER, AND UNLESS YOU AND BUCKLES & BUCKLES PLC AGREE OTHERWISE IN WRITING, THE ARBITRATOR(S) MAY NOT CONSOLIDATE MORE THAN ONE INDIVIDUAL PARTY’S CLAIMS WITH ANY OTHER PARTY’S CLAIMS, AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR COLLECTIVE PROCEEDING AS IT RELATES TO OR ARISES OUT OF, THESESMS TEXTING TERMS AND CONDITIONS OR OUR TEXTING SERVICE.
    • You and Buckles & Buckles PLC are each responsible for our respective costs relating to counsel, experts, and witnesses, as well as any other costs relating to the arbitration Unless you and Buckles & Buckles PLC agree otherwise in writing, the arbitration will take place in the county of your home address.
  17. Definitions: “You” and “your” refer to the person who enrolls and uses the Buckles & Buckles PLC texting service. “We,” “our,” and “us,” refer to Buckles & Buckles PLC, attorneys, appearance counsel, staff, paralegals, legal collectors, collection managers as well as any other person or entity providing any texting service to you from Buckles & Buckles PLC or on our behalf.
  18. Modification of this policy and terms of use: Our Law Firm will notmodify these SMS Terms and Conditions without notice to you. You can find the most recent version on our website at https://www.bucklesandbucklesplc.com/.
  19. TERMINATION: We may terminate our text message program at any time. We may suspend or terminate the service to you if we believe you are in breach of our terms and conditions. Notification of termination will be provided by text if possible and prudent given the particular circumstances leading to the termination of the service. Additionally, your service is also subject to termination in the event your wireless service terminates or lapses.

In the madness of the recession and a divorce I had a credit card go into default. When the court papers came, i went in to court. Buckles had sent a young attorney, someone hired case by case. So, first caveat is go to court when you are served. The judge was looking to be fair. I had sent in my financial info, and we worked out a payment plan, no interest. My impression was that they represented the card company, not that they were collecting based on having bought the debt. At any rate, I have been ok with this, and on a few rare occasions have accidentally sent a payment late, but have been able to talk to the paralegal there and they did not push back into litigation. This may depend on whether or not it is likely for them to benefit from legal action. I'm pretty much dead broke LOL.
